The 57-year-old man took notes as he appeared via video link in Tamworth District Court on Friday morning.
The man’s identity has been suppressed by the courts, and he was due to be arraigned to enter pleas but DPP solicitor Cat McKay said the Crown was not ready.
“[The case] was in chambers being considered for bill finding,” she told the court, before adding only one set of charges had been found, and more time was needed to consider and finalise the second set.
“There is some further information that needs to be considered by the complainant.”
The man’s Legal Aid solicitor did not object to an adjournment until December.
That’s a six week period … I have expectations that on the 14th December everything will be sorted and ready to roll.
- Judge Jeffery McLennan

He’s accused of three counts of aggravated sexual assault of a person under the age of 16 as well as one count of committing an act of indecency.
The alleged incidents occurred in Tamworth and in Sydney between 2011 and 2013 when the alleged victim was aged between 11 and 13.
In separate incidents, he also faces charges of sexual assault category three knowing no consent given, carnal knowledge and committing act of indecency on a female under 16 years.
Detectives allege the incidents occurred in the North West in the 1970s and 1980s.
Much of the detail surrounding the alleged offences cannot be reported for legal reasons.
In June, the man waived his right to a contested committal hearing in Tamworth Local Court and instead elected to head straight to trial on seven charges.
The 57-year-old was arrested in Tamworth on November 23, 2017, by police from Strike Force Duncansby – an operation by Oxley detectives set up to investigate the historical allegations.
