Michael Hayes, 32, appeared in Tamworth Local Court via video link from isolation in custody.
Defence solicitor Garry Johnston confirmed he had received the evidence compiled by police just moments earlier.
"I have just been served a brief of evidence in that matter at the bar table," Mr Johnston said.
Police prosecutor Sergeant Rob Baillie said it would be helpful to know what was happening with the state prosecuting authority, the DPP, before the next court date could be set.

Prosecutors will now consider which charges to press ahead with against the accused.
Mr Johnston told the court there are basically just "two witness statements" and it should be a fairly short matter for prosecutors.
Magistrate Lisa Stapleton adjourned the case to November for charge certification, adding that if it was ready earlier "by some miracle", it could be relisted.
"Thank you, Your Honour," Hayes replied.
Bail was formally refused.
Police allege Hayes broke into an East Tamworth property knowing someone was home on the evening of July 31. The police case is that Hayes assaulted and intimidated the woman inside.
He was arrested by Tamworth detectives the following afternoon.
He faces three charges stemming from the alleged incident. No pleas have been entered.
