Troy Gregory Lance Norman remains in custody and did not appear in Tamworth Local Court last week when the court heard charges levelled against him had not yet been confirmed by the Crown.
Prosecutor Max Dixon from the state authority, the DPP, said it seemed there had been some "preliminary discussions" but more time was needed.
"The difficulty is this Your Honour, if it is listed for charge certification today, I am not in a position to certify," he said.
Mr Dixon told the court he had very recently taken over as the solicitor in charge of the case.

"I'll pick up the matter later this week," he told the court at the time.
He asked for a one month adjournment though noted Norman was behind bars.
Magistrate Lisa Stapleton adjourned the matter for two weeks and said that would "keep the pressure on".
Aboriginal Legal Service defence solicitor Joseph Healy did not oppose the delay and confirmed to the court his instructions were to commence "negotiations" in the case.
No application for bail was made and Ms Stapleton formally refused it.
Norman is accused of confronting a pizza shop driver while he was making a delivery to Edward Street on May 7.
Police told the Leader at the time that Norman approached the worker and threatened them before allegedly making them drive to the West Tamworth Domino's restaurant.
The delivery driver was able to alert management, police said. Norman was arrested in the area a short time later.
He is charged with being armed with the intent to commit an indictable offence; taking or detaining a person with the intent to gain an advantage; and resisting a police officer.
He has not entered pleas.
