TWO CHARGES against a man accused of breaking into a doctors' surgery and setting it on fire, have been dropped by prosecutors.

Andrew Robert Gillebaard appeared in Tamworth Local Court via video from custody, while his father sat in the court room to support him.
The Director of Public Prosecutions (DPP) has confirmed the charges they will proceed with in the case, and told the court prosecutors would pursue just one allegation and drop two others.
Gillebaard has been charged with break-and-enter and destroy property worth less than $60,000, after police claim a blaze broke out in the doctors' surgery in the Robert Street Shopping Centre arcade in the early hours of January 26.

The DPP certified the charge of damaging property worth more than $5000 by fire as an alternative offence.
Gillebaard has not been required to enter pleas to the allegations, but is expected to do so when the case returns to court next month.
Some of the details of the case cannot be reported for legal reasons.
Magistrate Julie Soars asked solicitors involved in the matter if a date for a case conference had been set, where lawyers would discuss issues. The court heard the meeting was set for later this month.
Gillebaard has been bail refused since he was arrested in the hours after the alleged break-and-enter in Tamworth.
The police case is that a fire broke out inside the surgery, which was quickly extinguished, and a crime scene was established.
Gillebaard was arrested and charged a short time later, and has remained in custody since.
The accused has been in Long Bay jail in Sydney as he recovers from health conditions, and the court heard he has been receiving treatment.
Ms Soars asked Legal Aid defence solicitor Wendy McAuliffe if an application for Gillebaard's release would be made.
"Not today your honour," Ms McAuliffe replied.
The case was adjourned.
