Police responded to reports of a man driving erratically on a main road in Inverell early on Tuesday morning.
The 26-year-old was allegedly seen travelling in a silver BMW on the wrong side of Warialda Road in Inverell before he hit the gutter.
Officers stopped the driver at the intersection of Warialda Road and Swan Street at about 5:30am, where police claim he returned a positive breath test.

The man was taken to Inverell Police Station and issued with an immediate license suspension notice and a court attendance notice for a high-range PCA reading.
Police issued the man a second court attendance notice for allegedly carrying a knife without a reasonable excuse.
The 26-year-old man will appear at Inverell Local Court on August 6.
