The application, submitted by Monteath and Poweys on behalf of FoodWorks owner Peter Hay, has been delayed, approved and rescinded as a result of pressure from the local historical society who felt its "bulky" look would be a blight on Bridge Street.

Now, the DA is back before Uralla Shire Council again and is recommended for approval on the basis it complies with 51 construction conditions.

In a letter to the council, Monteath and Powey's senior planner Rebecca Boresch thanked the council for the opportunity to respond to concerns, and agreed to additional conditions.

"Subsequently, it is anticipated that Council will now complete its statutory obligations and determine the application at its earliest convenience," council documents state.

"Should this not be the case, further inquiry will be made with the Minister of Local Government in requesting a review of this particular development application."

The new-look supermarket was first put to the council in November 2019 for additions and alterations to the FoodWorks, as well as a new carpark with 34 spaces and demolition of existing structures on the site.

It was first approved at the June council meeting, but a motion to rescind the decision was lodged by councillors shortly after for the developer to address concerns raised with traffic and pedestrian management, disabled access and retention of trees and the bus parking shed.

Council staff met with the developer in July to discuss the issues and as a result additional planning conditions have been recommended to the council.

A report to council argues there is "no valid planning reason ... which would warrant refusal of the application", and "the proposal should contribute to the amenity of Uralla residents and the travelling public by providing improved shopping facilities, and no significant adverse impacts are known or expected should the application be approved".

Councillors will vote on the development again on Tuesday night.
