A man in his sixties was arrested after failing a breath test about 8.20am on Australia Day on Ebsworth St, Tamworth.
He told officers he had stopped drinking about 11.30pm the night before and thought he was right to drive.
He was taken to Tamworth Police Station before blowing 0.049 – just under the legal limit.
“He came within .001 of going to court and having a criminal conviction against his name, so police are urging drivers to rest and recover before getting behind the wheel,” Highway Patrol Sergeant Michael Buko said.
Operation Safe Return – which carries double demerits – runs until midnight on Sunday.
