Culleton, who was arrested earlier on Monday morning by Armidale police after handing himself in, challenged the conviction for larceny which stems from an alleged dispute in Guyra in 2014.
In Armidale Local Court on Monday afternoon, Magistrate Michael Holmes granted Culleton’s annulment application, and annulled the larceny conviction, which was made when he failed to appear in court in March.
Culleton will fight the larceny charge, after pleading not guilty.
Mr Holmes adjourned the case to September 12 for mention to fix a hearing date.
He told the court if the matter “was short” he could deal with it on that day.
Mr Holmes told Culleton to keep in contact with his solicitor, and dispensed his bail, which was granted by police following his arrest.
Mr Holmes told the court he was happy to deal with the matter, and had read all the files.
He also referenced Culleton’s “colourful letter” which was sent to the court.
Fairfax Media understands the letter labelled the Armidale court as a “kangaroo court”.
It’s now expected Culleton’s district court challenge against the conviction, set down for next week in Armidale, will be withdrawn.
UPDATE: Newly-elected senator Rod Culleton has been arrested by Armidale police after handing himself in.
The One Nation senator was arrested and placed into police custody while the warrant was formally processed.
“A 52-year-old man attended Armidale Police Station where an outstanding arrest warrant was executed,” New England Inspector Chris Mckinnon told Fairfax Media.
“The man was granted unconditional bail by police to appear in Armidale Local Court this afternoon.”
Fairfax Media understands Culleton is trying to hide from media as he waits for his case to be heard.
He is trying to overturn a conviction for larceny in Guyra in April, 2014.
On Friday, The Leader revealed Culleton was risking arrest by entering NSW to challenge the conviction in court.
He reportedly told media on the weekend the report was “nonsense”.
He is due to appear in court at 2pm.
EARLIER: ONE Nation senator-elect Rod Culleton has handed himself into police in Armidale as he tries to have a larceny conviction overturned in court.
Culleton tried to avoid Fairfax Media outside Armidale Local Court on Monday morning, where he was due to appear after filing an annulment application.
The Western Australian and Guyra businessman was elected as a senator at the recent federal election but he is trying to have a conviction of larceny that he stole a car key in Guyra in 2014 overturned to enable him to take up the position.
A warrant was issued for his arrest earlier this year in Armidale after he failed to show up to court to answer the charge.
During brief proceedings on Monday morning in Armidale Local Court, Magistrate Michael Holmes ordered Culleton to ‘sort out’ the section 25 warrant with police, and stood the case in the criminal list to Monday afternoon.
Fairfax Media can confirm Culleton then went to the Armidale Police Station where the warrant was expected to be executed by police.
A spokesperson for NSW Police was unable to confirm if Culleton would be formally taken into police custody, or if he would be released on bail, pending a reappearance at court on Monday afternoon.
