Peter James Cupples sat silently in the dock of Tamworth Local Court yesterday morning, charged with one count of aggravated robbery after an incident in a motel room on the New England Highway on Saturday night.
Magistrate Michael Holmes said the facts of the matter were “very unusual” and “were concerning”.
“The allegation is that in essence he was dealing with a prostitute and ... apparently duct tape was involved,” he detailed in court.
“And he stole $180 and then ran from the scene.”
The 39-year-old was arrested shortly afterwards by Tamworth police and was refused release on Sunday morning at bail court.
The court heard the alleged victim was “a fly in, fly out” worker who had returned home.
Solicitor Fiona Hadlington said the charge of robbery using corporal violence could be reviewed – “It’s a serious charge, and a serious set of facts,” she said.
“I’m not sure the charge is right; the DPP will need to have a look at that.”
Police prosecutor Sergeant Matt Pawsey said the prosecution was not opposing bail but had agreed to a strict regime of conditions for Cupples’ release.
“There are certainly bail concerns that can be mitigated with those conditions,” he said.
The court was told Cupples has strong ties to the Manilla community, was on government benefits and could report to police every day.
Mr Holmes said that, although Cupples had a “clear record”, he was proposing strict conditions.
“There is a concern that needs to be addressed of endangering the safety of victims, witnesses and the community,” he said.
“It’s a bit unusual but I’m going to impose a condition not to engage the services of sex workers whilst he is on bail.”
In order to secure his release, Cupples and another “acceptable person” were ordered to post $500 surety each.
The case was adjourned to later this month.
