The 23-year-old – who can’t be named for legal reasons – had been undergoing a mental health fitness inquiry at Sydney during the past two days.
The man remained in custody – believed to be in a unit for the intellectually disabled in prison – during the course of the trial into the death of the three-year-old Narrabri boy.
The man was facing charges of murder and aggravated sexual assault of the boy in September 2010.
He was accused of raping the young boy and then assaulting him at a Narrabri home which resulted in the child being airlifted to Sydney, where he later died. He had suffered head injuries.
At yesterday’s court appearance, Justice Megan Latham referred the man to the Mental Health Review Tribunal for assessment at the earliest opportunity.
