Phillip Doorey, 45, will have to post $100,000 surety to secure his release to see a heart cardiologist, treatment his solicitor argued he could not access while in prison.
Rae Parker told Tamworth Local Court her client was at considerable risk while in custody of not receiving proper treatment.
“If he doesn’t receive appropriate treatment, his heart will fail,” she told the court.
“He has been diagnosed with cardiomyopathy ... it is a serious illness.”
Doorey was arrested on June 27 along with his co-accused wife, Kim Doorey, by detectives attached to Strike Force Gavey. The strike force was set up in May this year to investigate the supply of drugs in Tamworth, with the couple accused of supplying drugs, primarily out of their Garden St home, on a regular basis.
Police allege between May 20 and June 24, Phillip Doorey conducted 70 separate drug transactions in the local area.
In a bail hearing, spread over two days, Ms Parker said it was a “tricky case” because scientific analysis of the drugs had shown some of them had contained a synthetic substance known as Alpha PVP.
“Under the drug misuse and trafficking act ... that was not prohibited ... but it is now,” she said.
Ms Parker said the question centres on whether the drugs contained a legal structural analogue, defined by the government before synthetic bans were introduced into law.
After medical evidence supporting Doorey’s condition was tendered to the court, Magistrate Alexander Mijovich granted strict conditional bail, ordering two people to post $50,000 each surety.
The 45-year-old must not contact his wife, or any witnesses, report to police and reside in Tamworth.
Kim Doorey, 33, was granted Supreme Court bail to reside in Sydney earlier this year.
The case has been adjourned to January 15.
