Juan Augustus Sampson did not appear in Tamworth Local Court when his case was called earlier this month.
Aboriginal Legal Service defence solicitor Joseph Healy told the court the assault and attempted robbery matter should be ready to resolve after an agreement with the prosecution was made earlier that day.
He asked the court for a short adjournment.
"The prosecution will need time to lay charges," he said.
Magistrate Julie Soars agreed to list the case again on Wednesday.
"Mention for resolution," she noted.

The court heard Sampson was on bail and Ms Soars continued his conditions.
Sampson was charged with one count of assault with intent to rob, armed with an offensive weapon after an alleged incident in January this year.
Police alleged at the time that a teenager and his friend were walking along the footpath near Robert Street when a ute stopped and Sampson and another man got out and confronted them.
Police claimed one was armed with a knife.
The teenager and friend managed to flee and alert a nearby house, according to police. Sampson was arrested and charged by Oxley police in the following days.
He has not yet entered a plea.
