Brandon James Booby, 25, was excused from appearing in Tamworth Local Court on Tuesday where the case was listed to set a hearing date.
Booby has pleaded not guilty to both charges of domestic reckless grievous bodily harm of his father; and assault occasioning actual bodily harm (DV).
The 52-year-old father was rushed to Tamworth hospital with critical injuries after an altercation broke out at a Merrinee Street home in Hillvue on March 5.

At the time, it was the police case that the 52-year-old allegedly threw the first punch at his son. Booby was arrested by police that night.
A brief of evidence has been served on the defence and the DPP is not electing in the case, which will see it remain in the local court and heard by a magistrate.
On Tuesday, magistrate Julie Soars fixed the case for hearing in early-November.
Booby was granted bail in court the day after the alleged assault on a raft of conditions including an overnight curfew; alcohol restriction; and reporting to police.
