Tamworth Regional Council was taken to the Land and Environment Court over its earlier decision to block an over-50s estate on the Longyard golf course.
The council argued it would clash with the neighbouring sports and events precinct and detrimentally effect future investments in the area.

The council ultimately lost the case even after it argued it was planning to build a regional stadium in the vicinity of the new estate.
Land and Environment Court senior commissioner Susan Dixon ruled the Longyard development was "not likely to cause land use conflicts or unreasonable restraint of the future use of the sporting complex."
"The evidence is that there are a maximum of 26 dwellings of the 99 proposed that potentially may be affected on limited occasions by noise from the stadium and the car park use," Senior commissioner Dixon said.
It appears the stadium would be built to cater for Aussie Rules and cricket.
"At the end of the day, some people will choose not to live in the [manufactured homes estate] because of its proximity to the stadium and the sporting precinct more generally," she said.
"Those that decide to reside there will appreciate that they will be living next door to potential noise from regional sporting facilities at various times of the year."
The final judgement on the case said "five annual regionally significant events may be held" and at least 80 per cent of events in the precinct "fully comply with the agreed acoustic criteria".
Developers will have to factor in "design controls" to address acoustic issues which might arise with the 26 at risk lots.
It aligns with the recent release of the council's Bicentennial Park draft masterplan which foreshadows the council developing Number One Oval on Kable Avenue into a "boutique sports field" and events space.
The Leader understands there is council-owned land adjacent to the site currently being developed into new hockey fields which could be earmarked for a new sporting oval.
