Dale Ross Toomey and William Toomey are accused of attacking the off-duty senior constable at a cafe in Danger Street in Pilliga on the morning of April 9.

Both men have pleaded not guilty to allegations of assaulting a police officer during the execution of their duty and occasioning actual bodily harm (ABH); and offensive language; while Dale also faces an additional count of intimidation.

If found guilty of the charge of assaulting police occasioning ABH, the pair face a maximum of seven years' imprisonment.

After a brief of evidence was served in the case, solicitors for both men confirmed the not guilty pleas to the charges in Wee Waa Local Court, and asked the case to be set down for hearing.

Seven witnesses are expected to give evidence in the case, which magistrate Alexander Mijovich set down for hearing in the same court, later this month.

The court was told the hearing would span three hours.

William admitted to one charge of possessing a prohibited drug, and following the guilty plea, will be sentenced after the hearing.

Police allege the senior constable suffered bruising and swelling to his face after he was confronted at the Pilliga cafe, at about 10am, on the April morning in question.

Officers allege the pair, aged 44 and 18, punched the senior constable, who was off-duty at the time, several times to the face before witnesses intervened.

The pair then left the cafe and were later arrested.

Magistrate Mijovich continued the pair's bail ahead of the hearing.
