Anthony Raymond Taylor is charged with binding, gagging and sexually assaulting a 54-year-old woman in her East Tamworth home on February 9.
Solicitor Geoffrey Archer told Tamworth Local Court on Wednesday his 58-year-old client was in custody but "doesn't need to come up on the screen".
He said he had been away and his staff had been unable to push the case forward because they had "been unable to organise [a case] conference".
A case conference allows lawyers and the prosecution to meet and discuss the issues in the case and make any possible formal plea offers or negotiations.

The court also heard the DPP wasn't ready to certify any charges in the case, needed before the case conference could proceed.
"We need phone download material," DPP solicitor Ellen Tiedeman told the court, adding the brief was sufficient but more time was needed "to complete further reports and allow the further material to be served".
Magistrate Julie Soars granted more time to both sides, ordering the case back to court in late June.
"I'm mark him as bail not applied for, refused," she told the court.
Detectives will allege the assault wasn't random but that Taylor targeted his victim.
Strike Force Yulong was set up by the state's sex crimes squad and Oxley detectives to investigate the sexual assault.
It is the Crown case that Taylor made several attempts to contact and meet the woman in the days after the attack.
Detectives seized Taylor's phone and will allege they found videos of the woman, filmed outside her home without her knowledge.
A property in East Tamworth was raided as part of the investigation and several items of interest seized, police said at the time of his arrest.
Taylor was first denied bail after his arrest in February.
