Aubrey Michael Flick, 35, was convicted of intentional grievous bodily harm [GBH] in Tamworth District Court on Wednesday.
“I’m going to f****** kill you, I’ll kill you motherf******, I’m going to kill you, I’ll watch you die tonight,” Flick screamed as he stabbed the victim in Coledale in 2016, the court heard.
In the midst of alcohol-induced delirium, Flick believed the victim to be one of his relatives who allegedly sexually assaulted a child known to Flick.
The victim forgave Flick for stabbing him repeatedly and causing life-threatening injuries that would have proved fatal without medical intervention, the court heard.
I’m going to f****** kill you, I’ll kill you motherf******, I’m going to kill you, I’ll watch you die tonight.
- Aubrey Michael Flick
Critical care specialists at Tamworth Hospital reported the victim had life-threatening injuries and was treated for stab wounds to his neck, chest, abdomen, shoulder, armpit, left forearm and knee and had numerous wounds requiring emergency surgery.
The victim had a laceration to his liver and the knife had penetrated his diaphragm, part of his colon and stomach.
He sustained a 30mm diameter bruise to his head and required further surgeries for bile leaks from the liver injury.
Flick was charged with attempted murder but on the last occasion it was downgraded to intentional GBH as a result of substance abuse problems and potential underlying mental health issues.
Forensic psychiatrists are unable to determine if Flick suffers from a mental illness as he continues to abuse methamphetamine while still in custody, the court heard.
“He’s got a criminal history of conducting himself in a violent fashion, what are we going to do with him?” Judge Jeffery McLennan asked.
“In my mind he spends his entire life as he says, using drugs and alcohol is what he does – even when he’s in prison he uses drugs and alcohol.
“We know he commits offences when he’s out because of drugs and alcohol and he shows no signs of abating.
“I don’t know if he has prospects of rehabilitation, you can be as sure of that as you can be of anything.”
Go away! You don’t want to do this bro, we are family, stop.
- Witnesses heard the victim yell
Flick and the victim had gotten drunk and spent time together before August 17, 2016 when the relationship turned sour.
The victim wasn’t home when Flick arrived at his house so instead he smoked “several cones” and left, before returning in the afternoon. The pair spoke amicably until Flick pulled two knives out and chased the victim toward Sue Crescent.
“Go away! You don’t want to do this bro, we are family, stop,” witnesses heard the victim yell, lying on the ground he tried to shield himself from the knives with a children’s toy Go Kart.
Witnesses watched Flick repeatedly stab the victim in the body and fled the scene, until he was stopped by police covered in blood spatters and brought into custody.
Public defender Stuart Bouveng said Flick grew up in an abusive household with an alcoholic father before he left the family home and lived on the streets.
Flick was sentenced to seven years in prison for intentional GBH and six months already served for spitting on police during the arrest.
