Dean Robert Squire is accused of sexual intercourse without consent of one woman and assaulting with an act of indecency of another in Tamworth, in the early hours of January 22.
The now 28-year-old senior constable, who is based in the Central West, was excused from appearing in Tamworth Local Court on Wednesday morning.
Agent solicitor Kevin Carr told the court Squire intended to plead “not guilty on both sequences” and that on his instructions, “we are in a position to commit but the DPP weren’t”.
Magistrate Julie Soars said because the DPP elected on both charges, meaning they will be heard in the district court for trial or sentence, no pleas needed to be entered in the local court.
I’ve indicated pleas of not guilty but we don’t formally take pleas.

DPP solicitor Cat McKay asked for an adjournment to finalise the brief and negotiations, with Squire unable to be committed to the higher court in his absence.
“There is some material outstanding ... but I understand it is sufficient for the purpose of negotiations,” she said.
“Although there doesn't appear to be any prospect of that.”
The case was adjourned to July.
In April, a Dubbo magistrate refused a notice of motion to suppress the case or Squire’s identity.
Squire, who remains on bail, is suspended from pay.
He was arrested and charged on February 22 at Dubbo Police Station, following an investigation.
