The Northern Joint Regional Planning Panel (JRPP) was due to hand down its decision on the controversial development in Tamworth today.
But on Wednesday the JRPP received last-minute legal advice that cast doubts over whether the panel had jurisdiction over the matter.
The panel's chairman Garry West told a press conference today that he had "erred on the side of caution" and sent the matter back to council for determination.
West Tamworth League Club is seek approval to build a 53-room motel and function centre on the site of Scully Park No. 1 Oval.
