About 3.15pm on Monday, police were patrolling Manilla Rd at Oxley Vale when they spotted a man and a young child riding an unregistered quad bike along a section of roadworks.
The 33-year-old rider was breath-tested at the scene and returned a positive reading.
He was arrested and taken to Tamworth Police Station where he allegedly blew 0.234 – almost five times the legal limit.
He has been charged with high-range PCA, being unlicensed, using an unregistered vehicle, using an uninsured vehicle and rider and passenger without a helmet.
He has been ordered to appear in court on September 1.
