Existing laws lean towards a presumption against granting bail for many offences. This, according to the review, has served to fill prisons and depart from basic principles of justice including the presumption of innocence.
''In recommending a presumption in favour of bail, we do not envisage that people who present a serious risk of absconding, committing serious crime, or threatening another's safety should be released,'' the report says.
