Knife attack victim Bernard Waters was unarmed, witness says

TAMWORTH man Bernard Waters was unarmed when a machete-wielding man ran towards him and struck him on the top of his head, a jury heard yesterday.

A Sussex St tenant who witnessed the June 2010 attack on Mr Waters yesterday gave evidence in Tamworth District Court that she believed the man responsible was Ian Scott Prince, who is on trial over the attack.

In a recorded interview with Tamworth detectives played to the court, photos of 14 men were shown to the woman who told officers she was "90 per cent" sure Prince was the man who struck Mr Waters with the machete.

As part of evidence in the crown case yesterday, the woman said she was inside her Sussex St home when a verbal argument broke out between people in her backyard and people in Centennial Park, next to her home.

The woman told the court that when the argument began to escalate, she walked to her door to find a person running towards Mr Waters at a fast pace and holding a machete, which was about one metre in length.

"To my knowledge it was (Ian) Scotty Prince," the woman told the court.

The woman conceded the street was not well lit and it could have been difficult to see who was holding the machete.

"From what I saw it could have been him," she said.

She said the man holding the knife was holding it "up in the air" with both hands while running over to Mr Waters.

"I went inside straight away and rang the ambulance," she said.

She said it was about that time that Mr Waters came into her house for help.

She provided him with towels to stem his bleeding.

Prince was charged with wounding with intent to cause grievous bodily harm and affray, a month after the attack.

During opening statements by the crown, the jury was told Mr Waters did not see who struck him with the knife.

The crown said it was the jury's job to decide if Prince had any involvement in the attack.

The trial continues.
